MR DIY PRIVACY NOTICE REGARDING THE PROTECTION OF PERSONAL DATA OF EMPLOYEE CANDIDATES

 
In this Privacy Notice, the principles concerning the processing of your personal data by MRDIY Turkey Ev Gereçleri ve Yapı Malzemeleri İthalat A.Ş. (‘Company’) as the data controller based in “Esentepe Mah. Büyükdere Cad. Ferko Signature Blok No: 175 İç Kapı No: 7 Şişli/İstanbul” are indicated below, in accordance with Turkish Law on Protection of Personal Data no. 6698  (‘Law’), European Union General Data Protection Regulation (“GDPR”), and other applicable legislation.
 
1. The Purpose of Processing Personal Data

Your personal data which is collected as a result of your application to work in our Company is processed for the purposes of receiving your application, examining your resume, evaluating your suitability for the relevant position, executing the recruitment processes, and contacting you in this context in accordance with the basic principles stipulated by the Law and within the scope of the purposes and conditions of personal data processing which is indicated in the Article 5 and 6 of the Law.
 
Application Processes: Your credentials (name, last name) and contact information (email address, phone number, mailing address) are going to be processed for the purposes of receiving your application for the determined position within our Company and to be able to contact you when it is necessary.
 
Evaluation Phases (The Processes of Evaluation): With the purpose of evaluating the suitability of your application for the relevant position and whether you meet the qualifications and criteria sought for the position, your professional experience information (diploma, courses you have attended, certificates, education information, foreign language proficiency, other skills, and qualifications), personal information (resume information, previous salary, previous workplaces, features, position, experiences, working dates, your reason for leaving), your military service status, depending on the position you applied for if necessary your foreign language proficiency exam results and the information of whether your first-degree relative works in our company will be processed.
 
Interview Processes: With the purpose of the evaluation of the suitability of your application for the relevant position, within the scope of the meetings we will have with you, your identity (name, surname), personal information (your current salary and the information of your side-benefits, your institution/position information),  in case of a video interview; your visual and audio recording information(your conversations are not recorded separately, only images are mutually processed during the interview), your salary expectation, The reason for changing your job, the answers you gave to the interview questions and comments about your interview (interview date, interview comments, feedback information, department and position information) will be processed.
 
Reference Research Processes: With the purposes of organizing reference calls with your references, getting information about you from references, evaluating your suitability for the position, your identity information (name, last name) and personal information (position, institution, duty, the dates of work with the reference, the position and content of the candidate, the reason for leaving the job, relations with the manager, teamwork/compatibility with the team, learning and analytical thinking competency, subjects which he/she may be motivated or demotivated about, attitude towards the job and the institution, aspects of development, the answers given to the questions on the reference form such as the general opinions of the reference) will be processed.
 
(Note: To conduct reference calls, due to us processing the personal data (credentials, (name, last name), contact (email, phone number) of the references, personal information (position, the institution he/she works for, his/her professional relationship with you and the answers to the questions asked) of the references, the responsibility of giving the necessary disclosure to your references on behalf of our Company and in related conditions obtaining express consent on behalf of our Company belongs to you.)
 
Offer Processes: In the case of you being accepted for the position you have applied for, for the purposes preparing of the work offer, drawing and executing the work contract, and forwarding it to you, your contact information (email, phone number, your address limited with the city and district) and personal information (the amount that has been offered and information regarding the side-benefits) will be processed.
Security Camera Processes: In the event of you visiting our place of work (Main office and stores) for your job interviews for the purpose of securing your security footage will be processed.
It is essential to our Company not to collect your data other than your personal data which will be sufficient for the evaluation of your suitability for the job and the position. Due to this, we ask of you not to share your personal data and especially your sensitive personal data (such as medical knowledge, association, foundation or union membership, etc.) in your applications and the resumes you will share with us other than the personal data mentioned below and which will be sufficient for the evaluation of your suitability for the position.
 
In the case of you giving explicit consent (separately)
  • Handicapped Staff: If your application regards the handicapped staff of our Company, your information regarding your disability in order to evaluate your suitability for this staff,
  • Keeping the application for the positions that may arise in the future: If you want your personal data that was processed throughout the application process to be evaluated for the suitable job positions that may arise in the future, for 3 years your information regarding your application, will be processed in addition.
 
2. The Places The Processed Personal Data Is Transferred To and the Purpose of Transfer

We may share your personal data with our suppliers from who we receive mail server service, who enable us to carry out the recruitment activity, and if necessary for the foreign language test to be done. We may share your personal data with the authorized State Institutions and Organizations in order to fulfill our legal obligations, exercise our legal rights, and make the necessary notifications and registrations.
 
Affiliates: If you give explicit consent in addition, to the evaluation we may share your personal data that was processed throughout the application process with our Company’s headquarters abroad.
 
3. The Method of Collecting Personal Data and Legal Reason

Your personal data is obtained in accordance with the Law with the job application form you fill out on our website, with the applications you make via mail or other channels, with saving in our systems your personal data that you share on the career platforms where you make your personal data public, when the current employees within the Company or third parties outside the Company recommend you for the relevant positions and your information shared with us is uploaded to our system, by saving the information shared with us by the consultancy companies we work with in our systems, by saving the information you give during the job interview or the evaluations to be made by our officials and the proposal to be prepared as a result of this evaluation, by sending the information of the reference to us by email or by various means, with the references you will share with us by saving the information obtained from the interviews we have made, with security cameras if you visit our workplace (head office or stores), with an intermediary program that allows video interviews in case of video interviews for job interviews, with saving the privacy notice information we provide to you and saving your information in our systems in the open consent and disclosure processes made in electronic environments by automatic methods or job application forms you fill in stores, by saving the applications you will make face-to-face,
by saving the information you will provide during the job interview or the evaluations to be made by our officials and saving the offer to be prepared as a result of this evaluation to physical environments, by these being delivered to us by hand or by cargo, and by non-automatic means in the express consent and clarification processes made in writing.
 
With the methods mentioned above;
  • Your personal data that concerns your job application process is processed on the basis of legal reasons that ‘on the condition that the personal data directly regards the establishment or the execution of a contract the processing of personal data of the contracting parties is necessary ’, ‘on the condition that it does not harm the rights and freedoms of the person concerned data processing is mandatory for the legitimate interests of the data controller’ and ‘made public by the person concerned.’
  • Your personal data that concerns the security camera processes are processed on the basis of the legal reason that ‘on the condition that data processing is mandatory for the establishment, exercise or protection of the right’.
 
Also in the case of you (i) wanting to apply for the handicapped staff, (ii) wanting your application to be shared with our Affiliates abroad, or (iii) wanting your application to be saved for the suitable positions that may open in the future, your personal data will be processed based on your ‘expressed consent.’ You can terminate the personal data processing activity based on express consent by withdrawing your explicit consent at any time and without any reason.
 

4. Application to the Data Controller and Your Rights
 
As per the Article 11 of  the Law and Articles 12 through 23 of GDPR, you are entitled to a) learn whether your personal data are being processed, b) if they are, request information, c) obtain information on the purpose of processing and find out whether personal data has been used as fit for the purpose d) obtain information about the third persons in Turkey and abroad, to whom personal data are transferred, e) request rectification of personal data that may have been incompletely or inaccurately processed, f) request the deletion or destruction of personal data as per the  Article 7 of the Law and the Article 17 of GDPR g) request notification of the operations made as per indents (e) and (f) to third parties to whom personal data have been transferred, h)  object to occurrence of any detrimental result by means of analysis of personal data exclusively through automated systems and i) request compensation for the damages due to unlawful processing of personal data.
